GOSI
Introduction
GOSI or The General Organization for Social Insurance is the amount payable by the employer on behalf of the employee to the National Authority. The fixed percentages of nationals and expats are mentioned below.
The amount paid effectively adds towards the retirement benefits of the National employees, and for expatriates it adds towards work related injuries fund which is limited to a certain amount.
Nationals | Expats |
22% payable on Basic salary and | 2% on basic salary and housing allowance |
Housing allowances. | Other allowances are exempt, except commissions |
Other allowances are exempt, except commissions
As per general practice and rules, | The employer pays complete amount payable |
½ of the total GOSI payable is paid by | No amount is taken from the employee. |
the employee and ½ by the employer.
Alternatively, the company can elect to
Pay the ½ GOSI of the employee. |
There are fines and penalties payable for late payment of GOSI amounts, not removing a national from GOSI register of the employer after resignation, and also fines/penalties on differing salaries on contract and GOSI registry.
As anyone in KSA would know the rules are constantly changing, kindly write to me regarding any changes to the above, and also let me know how the above has helped you.
This is just the basic introduction to GOSI. Hence, I don’t accept any financial liability or otherwise as result of the above. This is just advice resulting from my personal and professional experiences.

Hi Sir, want your advice on GOSI. In a company if the basic + HRA is 20% of salary component & balance 80% is stated as other allowance is it legal

It needs to be as per employment contract. The salary break down as per Saudi Norm is Basic SR XXX, Housing (Basic*0.25), Transportation (Basic*0.10)
Hope this helps. Any attempt to unfairly reduce GOSI payment is illegal and subject to huge fines (including MOI/MOL system being frozen)

Please contact your company HR on this as most resources under this are in Arabic.
If your HR is not aware of the rules he can call the GOSI office or visit them to get understanding of Basic Rules.

Dear Kamran,
Thank you for the article. Not sure if you are still receiving replies, but you mentioned that for any commission payments one has to pay GOSI at 2%. Please let me know if we pay commission as an annual bonus would GOSI still be payable?
Best Regards,
Khalid

GOSI only applies to Basic salary + Housing allowance, and not commission or bonuses, as these are subject to performance.
Hope this helps.

Please have a look here of chapter 1 of GOSI. How do we interpret this.
Please see relevant chapters below:

9. The term “basic wage” means the amount received by the contributor, who is compulsorily covered under the Law, in consideration of his work by virtue of a written or unwritten contract regardless of the method of payment or computation of such wage, less the allowances that may be granted according to the work nature, risk or place or for overtime working hours or for any other reasons no matter under whatever titles they are granted for, and less the grants, annual bonuses and benefits in kind. There shall be considered as basic wage the commission, the percentage of the sales value, and the percentage of the profit notwithstanding that it may be paid alone or in addition to a fixed wage.

From what I understand, this is referring to part – time Saudi employees, any amount paid to them whether commission or bonus is considered under basic wage.

How the GOSI calculation made if an employee joins in the middle of the month ?

Pro-Rata I believe. It is common for employers to waive first month GOSI on Saudi Employees if they join middle of the month, or wait 15 days before registering them on the System.

The company GRO needs to visit GOSI office and determine the calculation of the same. This appears to be a common problem where info on their website is not matching with the compensation payout. I highly recommend visit to their compensation department to get clarification.

Hello Mr. Kamran,
The GRO of AL- Yamama Mr. Tarek Mansour already provided a salary modification to GOSI in Yanbu and then he said on his mail that we will receive a extra compensation from GOSI. But GOSI compensation told me that no extra compensation to be issued to us. But why ? Please help and thanks.

Unfortunately, I can’t help with this. My area is to help with accounting for GOSI and not advise on the law itself.
I suggest you hire a good lawyer.
